These Website Terms of Use (“Terms of Use”) set out the rules for accessing and using The Models’ Masterclass website (themodelsmasterclass.com) and any related online services. They apply to all visitors and users of our site, whether or not you have an account or purchase a course. By using our website, you agree to follow these terms. If you do not agree, you should not use our site.

Please read these Terms of Use carefully. They incorporate our Privacy Policy and Cookie Policy (above), which describe how we handle your data, and our Terms and Conditions (for course purchases). If you violate these Terms of Use, we may suspend or terminate your access to our site.

1. User Accounts and Security

Account Creation: Some areas of our website (such as purchasing courses or accessing course content) require you to create an account. When creating an account, you must provide truthful, accurate, and complete information about yourself. Do not impersonate anyone else or create an account using someone else’s information. You are responsible for updating your account information if it changes, so we can maintain accurate records.

Account Responsibility: You are responsible for maintaining the confidentiality of your account login credentials (username and password). You must not share your password with anyone else. If you suspect that someone else knows your password or has accessed your account, you should reset your password immediately and notify us of any unauthorized access.

One Account Per User: Each user should have only one account (unless otherwise approved by us). You must not register multiple accounts to abuse our systems or gain multiple free trials, etc. Similarly, you should not allow multiple individuals to use your account. Our courses are licensed per individual; sharing accounts is a breach of these terms.

Security Measures: We employ security measures to protect the site and our users. However, you also agree to take reasonable precautions. This means you will use a strong, unique password, use caution when accessing your account from public or shared devices, and log out when finished. We are not liable for any loss or damage arising from your failure to adequately safeguard your account credentials.

Notification of Breach: If you become aware of any actual or suspected breach of security on our site (such as unauthorized use of your account or our services), you agree to notify us promptly at [email protected]. We will work with you to take appropriate steps to secure the account and investigate the issue.

2. Acceptable Use Policy

We want all users to have a safe and enjoyable experience on our platform. To that end, when using our site or any interactive features (such as forums, chat, or comments), you agree to follow these rules of acceptable use. You must use our site only for lawful purposes and refrain from any misuse of the platform:

No Unlawful or Harmful Activity: You may not use the site in any way that violates any applicable local, national, or international law or regulation. This includes not engaging in fraudulent activities, not exploiting the site to propagate malware or engage in cyber-attacks, and not using the site for any form of cybercrime. You also must not use the site to harm or attempt to harm others. For example, you shall not use our platform to stalk, harass, or threaten another person, and you will not advocate violence or hatred.

No Unauthorized Access or Disruption: You must not attempt to gain unauthorized access to any portion of our website, the server on which it is hosted, or any server, computer, or database connected to our site. Probing, scanning, or testing the vulnerability of our system or network (or breaching security or authentication measures) without proper authorization is prohibited. Likewise, you agree not to interfere with or disrupt the availability of our site, for example by introducing viruses, Trojan horses, worms, logic bombs or other material that is malicious or technologically harmful. Deliberate attempts to overload the site (e.g. via denial-of-service attacks) or use of automated scripts to scrape or excessively call the site may result in immediate termination of access and potential legal action.

No Spamming or Unsolicited Communications: You must not use our site to transmit or facilitate the sending of any unsolicited or unauthorized advertising or promotional material (for example, junk mail, spam, chain letters, pyramid schemes, or any other form of solicitation). Posting repetitive comments or content with the primary aim of advertising or self-promotion (outside any areas expressly designated for such use) is not allowed.

No Misuse of Content or IP: You must not reproduce, duplicate, copy, or resell any part of our website or content in violation of these Terms or our Intellectual Property Rights Statement. This means you shouldn’t scrape content or databases, nor present our website within a frame on another site without permission. Additionally, you must not use any part of our site’s content (text, images, videos, etc.) for commercial purposes without obtaining a license from us (see Intellectual Property section below).

No Improper User Content: If interactive features (like commenting, forums, or chat) are available: you agree that any content you contribute will comply with the Content Standards in section 3 below. In short, you will not upload or share any content that is illegal, infringing, defamatory, obscene, pornographic (especially no content involving minors), hateful, or otherwise objectionable. You also will not share content that belongs to someone else (like copyrighted material or personal data) unless you have permission.

Respect for Others: You agree to be respectful towards instructors, staff, and fellow students or users. Any form of bullying, harassment, hate speech, or discrimination (based on race, gender, religion, sexual orientation, etc.) on our platform is strictly forbidden. We encourage constructive and positive communication in any community aspects of our site.

We reserve the right to review, monitor, and/or remove any user content or activity that we believe, in our discretion, violates these Acceptable Use rules or our Content Standards. Violation of the above rules may result in suspension or termination of your access as detailed in section 4 below, and may also expose you to legal liabilities.

3. User-Generated Content and Content Standards

Our website may offer opportunities for users to create or upload content, such as profile information, comments, reviews, or posts in discussion forums (if enabled for courses or blog posts). Whenever you contribute content to our site (“User Content”), you must ensure that it meets the following content standards. These standards apply to each portion of any content as well as to it as a whole:

Legality and Rights: Your content must be your own original work (or you must have all necessary rights and permissions to use it). It must not contain anything that infringes the intellectual property or privacy rights of others. Do not upload content you do not have the right to share (e.g., pirated materials, someone else’s copyrighted photos, or personal info about another person without consent).

No Defamatory or Harmful Material: Content must not contain defamatory statements (false statements that harm someone’s reputation) or knowingly false/misleading information. It should not include threats, harassment, or personal attacks. Avoid content that could cause annoyance, inconvenience, or needless anxiety to others.

No Obscenity or Hate: Content must not be obscene, indecent, or offensive. This means no pornographic material or overly graphic descriptions of violence. Also, absolutely no content that is hateful or discriminatory. Do not use slurs or epithets targeting any protected group, and do not encourage hatred toward any group or individual.

No Promotion of Illegal Activity: You should not post content that promotes or depicts illegal activities, or instructs others on how to carry out illegal acts. This includes content that glorifies violence, drug use, or any criminal behavior. Also, do not use the platform to buy, sell, or trade unlawful goods or services.

Relevance and Non-Spam: Ensure your content is relevant to the context. Off-topic posts or repetitively posting the same content (spamming) is not allowed. If the site has specific areas for certain topics, keep discussions in the appropriate channels.

No Advertising (unless allowed): Our platform is not to be used for unsolicited advertising or promotion of third-party products/services. You may not advertise or promote outside businesses, websites, or courses in your posts, unless we have explicitly allowed it (for example, perhaps in a designated “share your portfolio” forum where self-promotion is acceptable within guidelines). Any permitted promotion should follow the rules we set for that area.

By submitting User Content, you confirm that it meets these standards. We do not pre-approve all content, but we reserve the right to remove or edit any User Content that, in our judgment, violates these standards or any other provision of these Terms of Use.

Additionally, by posting any content on our site, you grant The Models’ Masterclass Ltd a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, display, and distribute your content within our website and services for the purpose of operating, providing, and promoting the platform. For example, if you post a testimonial in a forum, we might feature it on our site or social media (with credit to you) as allowed by this license. This license survives even if you delete the content or your account (but we will stop displaying it if you remove it from our site, in a reasonable timeframe). You still retain ownership of your content; this is just a permission for us to use it. If you do not wish to grant this license, please do not submit content to our platform.

4. Suspension and Termination of Use

We have the right to suspend or terminate your access to our website (including your user account) at any time if, in our reasonable opinion, you have violated these Terms of Use. Actions we might take include:

Immediate Suspension: If we detect behavior that poses a serious threat (e.g., hacking attempt, posting illegal content), we may immediately suspend your account and access while we investigate. During suspension, you may not be able to log in or use parts of the site.

Content Removal: We may remove or disable access to any User Content that violates our policies. For instance, if you post something infringing or offensive, we will likely take it down. We may do this with or without notifying you, depending on severity.

Warning or Notice: For less severe violations or if it’s a first offense, we might send you a warning, describing the issue and asking you to remedy it (for example, editing a profile image that is not appropriate). You are expected to comply with any corrective actions we request.

Termination of Account: If you seriously breach the terms or repeatedly violate them despite warnings, we may terminate your user account. Termination means your right to use our site and content is revoked. We may delete your profile and any content or data associated with your account. If your account is terminated, you must not attempt to create a new account or access the site without our permission.

Legal Action: If your misuse of our site is unlawful or harms us or others (for example, fraud, theft of content, defamation, etc.), we reserve the right to take legal action against you. This could include seeking injunctions (to stop your activities) or damages (to compensate for losses). We may also cooperate with law enforcement authorities as needed (such as providing information about illegal activities).

Refunds: If your account is terminated due to a breach of these terms and you had an active course enrollment, you will generally not be entitled to a refund (if the termination was due to your misconduct). We may make exceptions at our discretion depending on the circumstances.

You agree that we will not be liable to you or any third party for any termination of your access for cause. If you believe we have suspended or terminated your account in error, you can contact us to appeal the decision. We will review your request, but the final decision will rest with us.

Even after termination, certain provisions of these Terms of Use remain in effect, including intellectual property rights, disclaimers, limitations of liability, and any other clauses which by their nature should survive.

5. Disclaimers and Limitation of Liability (Website Use)

Accuracy of Information: While we strive to ensure that the information on our website (outside of user-generated content) is accurate and up to date, we cannot guarantee that all content is free of errors or omissions. For example, articles or FAQs on the site might become outdated. We make no warranties or representations that the site content is accurate, complete, or current. Use of any information obtained on our site is at your own risk. If you spot something that you believe is incorrect, we welcome you to let us know so we can correct it.

Availability: We do not guarantee that our website, or any content on it, will always be available or uninterrupted. As mentioned in the Terms and Conditions, downtime may occur. The site is provided on an “as is” and “as available” basis. We may also update or change the site’s content at any time. Though we try to avoid it, parts of the site may be out of date at any given time, and we have no obligation to update them immediately.

No Warranty: To the fullest extent permitted by law, we exclude all conditions, warranties, representations, or other terms which may apply to our site or any content on it, whether express or implied. Specifically, we do not guarantee that the site will be secure or free from bugs or viruses (though we implement security measures), nor that it will meet your needs or expectations.

User Interactions: If our platform allows users to interact (e.g., through forums or messaging), you understand that we generally do not screen user communications in advance. We are not responsible for what users say or do on the platform, but we may act after the fact to remove content or restrict users as described. Exercise caution when interacting with others online. Do not share sensitive personal information on public areas of the site. We are not liable for any negative interactions or disputes between users, but we will try to help if you report harassment or other policy violations.

Links to Other Sites: Our site may contain links to third-party websites or resources for your convenience (for example, a link to a partner’s site or a relevant article). These links are provided as a convenience only – we have no control over the contents of those sites or resources. We do not endorse the linked websites, and we accept no responsibility for them or for any loss or damage that may arise from your use of them. When you follow a link to an external site, you should read the terms and privacy policy of that site, as it is governed by that third party, not us.

Limitation of Liability: The Models’ Masterclass Ltd, and its directors, officers, employees, or agents, will not be liable for any loss or damage arising under or in connection with the use of our website or services, except as set out in the Terms and Conditions (see the Liability section above). In particular, we are not liable for indirect, special, or consequential losses, or for any loss of profit, loss of business, business interruption, or loss of business opportunity arising from your use of the website. We do not exclude or limit liability for anything that cannot be excluded by law (as noted, such as liability for personal injury caused by negligence, or fraud). But in general, if something goes wrong due to your use of this free website (outside of paid course transactions), our liability is highly limited.

Indemnification: To the extent permitted by law, you agree to indemnify (compensate) The Models’ Masterclass Ltd for any losses, liabilities, costs, or expenses (including reasonable legal fees) incurred by us as a result of your misuse of the site, violation of these Terms of Use, or infringement of any third-party rights by your content or actions. This means that if a third party sues us because of something you did on our platform (for example, you posted copyrighted material and we get a claim, or you defamed someone using our site), you will be responsible for the costs and damages we suffer or have to pay as a result. We will notify you of any such claim and discuss how to respond, but this clause is aimed to protect us from the consequences of users violating the rules.

6. Intellectual Property on the Site

(For a full statement, see the “Intellectual Property Rights Statement” section below.) In essence, we (or our licensors) own all the intellectual property rights in our website and the material published on it, including but not limited to the design, text, graphics, videos, logos, and software code. These works are protected by copyright, trademark, and other intellectual property laws and treaties around the world. All such rights are reserved.

Under these Terms of Use, we grant you a limited, revocable license to access and use the website for personal, non-commercial purposes, in accordance with these terms. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, or transmit any of the material on our site, except as permitted by us or by law (such as brief quotations under fair dealing/fair use, or features that enable sharing of certain content).

If you print, copy, or download any part of our site in breach of these terms, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made. Also, you may not use our trademarks or trade name (including “The Models’ Masterclass”) without our prior written permission, except as allowed by law.

For rules on using the course content specifically (which is part of the site), refer to the Intellectual Property Rights Statement below, which forms part of these Terms of Use.

7. General

Governing Law: Like our Terms and Conditions, these Website Terms of Use are governed by the laws of England and Wales. Any disputes relating to these terms or your use of the site will be subject to the jurisdiction of the courts of England and Wales, unless mandatory consumer laws give you the right to sue in another country (if you reside outside of England and Wales).

Changes to Terms: We may revise these Terms of Use at any time by amending this page. We’ll update the “last updated” date when we do so. Some provisions may also be superseded by notices or policies published elsewhere on our site. We recommend that you check this page from time to time to take notice of any changes we make, as they are binding on you if you continue to use the site. If you have an account, we might notify you of major changes via email or a notice on your account dashboard.

Contact: If you have any concerns about material on our site or questions about these Terms of Use, please contact us at [email protected]. We appreciate feedback and strive to resolve any issues promptly.

By using our site, you confirm that you have read, understood, and agree to these Terms of Use. Thank you for respecting these guidelines and helping to keep our community safe and enjoyable!
